1. Project Approval & E-Signature By applying your electronic signature to the Invoice, or by paying the Initial payment, you acknowledge and agree to the following:
Binding Agreement: You confirm that you have reviewed all project details, including the Invoice, dimensions, wood species, and 3D renderings. You verify that these documents accurately represent your requirements.
Locking Specifications: Your signature "locks in" the design and specifications. Any changes requested after this point (e.g., dimension changes, wood species swaps) must be approved in writing via a Change Order.
Re-Approval: Significant changes may require a re-issued invoice, which will necessitate a new signature or written approval to proceed.
Error Verification: It is your responsibility to verify all measurements and details before signing. Fallen Timber Furniture Inc. is not responsible for errors in dimensions or design that were approved by you in this stage.
2. Understanding Solid Wood Furniture All of our products are handcrafted from solid wood unless otherwise stated. Solid wood is a natural material with unique characteristics — no two pieces are exactly alike.
Please note:
Natural variations in colour, grain, knots, and texture are not considered defects.
We cannot guarantee an exact match to samples provided or shown.
Dimensional Tolerance: Dimensions and final appearance may vary slightly from drawings or descriptions. We adhere to a tolerance of +/- 1/2 inch on all dimensions.
Deviations from specifications may occur when necessary to improve the stability, appearance, or longevity of the piece. These adjustments are made at the sole discretion of Fallen Timber Furniture Inc.
Critical Specs: If any specifications are absolutely critical, you must inform us in writing before production begins.
These variations are normal and should be expected as part of the beauty of handcrafted solid wood furniture.
3. Expansion & Seasonal Movement Wood naturally expands and contracts with changes in temperature and humidity. We recommend maintaining indoor conditions between 18°C and 22°C with 30% to 45% relative humidity.
Seasonal movement may cause minor checks (cracks), warping, or gaps, particularly in species like White Oak, Red Oak, and Hard Maple (including all species of wood).
Exclusion: These are natural changes and are not covered by Fallen Timber Furniture Inc.
To minimize wood movement, we:
Built with properly dried wood between 8% to 12% moisture content, which is standard for Alberta.
Install heavy-duty 3/16" thick steel C-channels to reduce warping or cupping.
Use appropriate joinery and fasteners to allow seasonal expansion and contraction.
4. Care, Cleaning & Product-Specific Warnings To extend the life of your furniture, you must follow the specific Care & Maintenance Guide provided for your finish type. The guidelines in that document are incorporated into these Terms & Conditions by reference.
Keep in a climate-controlled space between 18°C and 22°C, with 30% to 45% relative humidity.
Avoid direct sunlight, heat vents, fireplaces, and extreme temperature changes.
Use coasters for drinks and trivets for hot or cold items.
Cleaning: Wipe with warm soapy water (preferably Dawn) and a soft cloth, or use the cleaner provided by Fallen Timber Furniture Inc.
Additional Instructions: You will receive a specific "Care Instruction" document attached to your invoice email. The guidelines in that document are incorporated into these Terms & Conditions by reference. Failure to follow those specific care instructions may void your warranty.
General Cleaning: Wipe with warm soapy water (preferably Dawn) or the cleaner provided. WARNING: Avoid harsh chemicals, ammonia, bleach, or abrasive cleaners. The use of such chemicals voids any warranty claims.
If Finished with General Finishes (Poly/Acrylic): You acknowledge the 21-Day Cure Period. The finish takes 21 days to reach full hardness. Fallen Timber Furniture Inc. is not liable for impressions, scratches, or marring that occur due to use during this initial hardening period.
If Finished with Osmo Polyx®-Oil: You acknowledge the Spontaneous Combustion Warning. Oil-soaked rags can catch fire by themselves. If you perform maintenance, you must dispose of rags properly (submerge in water). Fallen Timber Furniture Inc. is not liable for damages caused by improper disposal of maintenance materials
Warning: Avoid harsh chemicals or abrasive cleaners. The use of such chemicals voids any warranty claims regarding finish durability.
5. Limited Warranty We warrant our furniture to be free from structural defects in workmanship for a period of one (1) year from the date of delivery.
Coverage: This warranty covers the structural integrity of the piece, including joinery failure or hardware failure under normal use conditions.
Exclusions: This warranty does not cover natural wood movement (warping, checking, cracks, seasonal gaps) as described in Section 3. It also does not cover damage caused by misuse, neglect, environmental conditions outside the recommended ranges, or normal wear and tear.
6. Returns, Cancellations & Refunds Because each piece is made to order:
All sales are final — no returns or refunds.
In rare cases and at our sole discretion, we may approve a partial refund.
Cancellation Fee: If a refund is approved, a minimum cancellation fee of 10% of the total project cost will apply to cover administrative and design costs.
If significant time or materials have been invested, a refund will not be possible and the order must be completed, delivered, and paid in full.
Any approved deficiencies will be addressed through repair or adjustment, as determined by Fallen Timber Furniture Inc.
7. Payments
A 50% non-refundable Initial payment is required within 48 hours of receiving your invoice.
The remaining balance is due on or before the day of delivery or pick-up.
Delivery will not occur until the final balance is paid in full unless otherwise agreed in writing.
If delivery proceeds without payment in full, you agree to pay the remaining balance by the end of the delivery day. Failure to do so will result in interest charges and recovery costs.
Interest: Late payments accrue interest at a rate of 2% of the total invoice amount per month, starting one week after the due date.
We accept e-transfer, cash, or approved payment methods listed on your invoice.
8. Delivery, Storage & Acceptance Delivery & Storage:
Time Frames: Due to the custom, handcrafted nature of our furniture, we provide estimated delivery time frames in 2-week slots (e.g., Jan 1 - Jan 15, 2026 ) rather than exact dates. These estimates are subject to change based on production variables.
Upon notification that your order is complete, you must arrange for delivery or pick-up within 14 days.
Storage Fees: If you are unable to accept delivery within 14 days of completion, the final balance becomes due immediately. Additionally, a storage fee of $100.00 per week will be charged until the furniture is collected.
9. Intellectual Property & Marketing
Fallen Timber Furniture Inc. retains all intellectual property rights to the designs, drawings, and 3D renderings produced for your project.
We reserve the right to photograph the finished product for marketing, portfolio, and social media purposes.
10. Limitation of Liability Fallen Timber Furniture Inc. is not liable for:
Any injury or property damage resulting from improper use, installation, handling, or transportation of the product.
Damage caused by environmental factors, neglect, or misuse after delivery.
Liability Cap: To the fullest extent permitted by law, the total liability of Fallen Timber Furniture Inc. for any claim arising out of this agreement shall not exceed the total purchase price of the specific item giving rise to the claim.
11. Limitation of Liability & DIY Disclaimer
General Liability: Fallen Timber Furniture Inc. is not liable for injury or property damage resulting from misuse or environmental neglect.
Refinishing/Alterations: Fallen Timber Furniture Inc. accepts no liability if you (the Client) or a third party choose to refinish, sand, or alter the piece. Any such alteration voids the warranty regarding surface finish and timber stability. We are not responsible for chemical incompatibility ("orange peel", peeling) resulting from the use of third-party waxes or polishes.
12. Customer-Supplied Materials If you provide materials such as wood or hardware, we are not responsible for their performance, durability, or defects.
13. Force Majeure We are not responsible for delays or inability to complete an order due to events beyond our control, including but not limited to supplier shortages, shipping delays, natural disasters, or government restrictions.
14. Governing Law These Terms & Conditions shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein.
15. Changes to Terms We may update these Terms & Conditions at any time by posting the revised version on our website. Your continued engagement with us after changes are posted constitutes acceptance.
16. Acceptance (Sign-Off Sheet Integration):
Upon delivery or pick-up, you will be required to inspect your order.
A separate Delivery Acceptance & Sign-Off Sheet will be presented, which must be signed before the delivery team departs.
A copy of this signed sheet will be sent to you via email within 5 business days.
By signing this sheet, you explicitly acknowledge that:
The items have been inspected and meet the agreed-upon specifications.
You accept the furniture "as-is" at the time of delivery.
You are satisfied with the quality, craftsmanship, and finish.
You agree to pay the full remaining balance by the end of the delivery date.
Any concerns must be reported in writing within 24 hours of acceptance. Signing the Delivery Acceptance Sheet waives the right to claim visual or surface defects not reported within that 24-hour window.

THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.
Once you leave Fallen Timber Furniture's website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements. Google analytics: Fallen Timber Furniture's website uses Google Analytics to help us learn about who visits our site and what pages are being looked at.
SECURITY
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
COOKIES
To keep track of cart data, WooCommerce makes use of 3 cookies: woocommerce_cart_hash, woocommerce_items_in_cart, wp_woocommerce_session_ The first two cookies contain information about the cart as a whole and helps WooCommerce know when the cart data changes. The final cookie (wp_woocommerce_session_) contains a unique code for each customer so that it knows where to find the cart data in the database for each customer. No personal information is stored within these cookies.
AGE OF CONSENT
By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
CHANGES TO THIS PRIVACY POLICY
We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
If Fallen Timber Furniture is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
